Please read these terms carefully before using our concrete delivery and rental services.

1. Service Agreement

Curb Cart Concrete provides concrete delivery and U-Cart rental services in Utah. By placing an order or using our services, you enter into a binding agreement with us.

Order Acceptance

• All orders are subject to availability and our acceptance
• We reserve the right to refuse service for any reason
• Orders are confirmed via phone, email, or written communication
• Pricing is subject to change without notice until order confirmation

2. Delivery Terms

Scheduling and Timing

• Delivery times are estimates and may vary due to weather, traffic, or operational factors
• We will make reasonable efforts to deliver within the agreed timeframe
• Delays due to circumstances beyond our control are not grounds for cancellation or refund
• You must provide accurate delivery information and ensure site accessibility

Site Requirements

• Delivery locations must be accessible by our delivery vehicles
• Customer is responsible for site preparation and clear access
• Overhead clearance of at least 14 feet is required
• Ground must support heavy vehicle weight (minimum 65,000 lbs)
• Customer must be present during delivery or designate an authorized representative

3. U-Cart Rental Terms

Rental Period

• Standard rental period is 4 hours from delivery time
• Extended rental fees apply after the standard period
• Equipment must be available for pickup at agreed location
• Weekend and holiday rentals may have different terms

Equipment Use

• Equipment must be used only for intended concrete mixing purposes
• Customer is responsible for proper operation and care
• No modifications to equipment are permitted
• Customer must report any equipment issues immediately

4. Payment Terms

Pricing

• All prices include delivery within our standard service areas
• Additional charges may apply for extended delivery distances
• Prices are subject to change based on market conditions
• All prices are quoted in USD and include applicable taxes

Payment Methods

• We accept cash, check, and major credit cards
• Payment is typically due at time of delivery
• Commercial accounts may be established with approved credit terms
• Late payment fees may apply to overdue accounts

5. Cancellation Policy

Customer Cancellations

• Cancellations must be made at least 2 hours before scheduled delivery
• Cancellation fees may apply for short notice cancellations
• No cancellation fees for weather-related cancellations
• Refunds will be processed within 5-10 business days

Company Cancellations

• We may cancel orders due to weather, equipment failure, or safety concerns
• Full refunds will be provided for company-initiated cancellations
• We will make reasonable efforts to reschedule when possible

6. Quality and Specifications

Concrete Standards

• All concrete meets or exceeds industry standards for specified mix designs
• Customer is responsible for specifying appropriate mix for their project
• We are not responsible for concrete failure due to improper specification
• Quality issues must be reported before concrete placement

7. Liability and Insurance

Limitation of Liability

• Our liability is limited to the value of the concrete delivered
• We are not responsible for consequential or indirect damages
• Customer assumes responsibility for proper concrete handling and placement
• We are not liable for delays due to circumstances beyond our control

8. Force Majeure

We are not liable for failure to perform due to circumstances beyond our reasonable control, including:

• Weather conditions, natural disasters, or acts of God
• Labor strikes or work stoppages
• Government regulations or actions
• Equipment failure or material shortages
• Traffic conditions or road closures

9. Dispute Resolution

Governing Law

These terms are governed by the laws of the State of Utah. Any disputes will be resolved in Utah courts.

Resolution Process

1. Direct negotiation between parties
2. Mediation if negotiation fails
3. Binding arbitration if mediation is unsuccessful
4. Court proceedings as a last resort

10. Privacy and Data

Your personal information is handled according to our Privacy Policy. By using our services, you consent to our data collection and use practices as described in our Privacy Policy.

11. SMS/Text Messaging Terms

By opting in to receive SMS/text messages from Curb Cart Concrete, you agree to the following terms:

Opt-Out Instructions

You may opt out of receiving text messages at any time by:

After opting out, you will receive a one-time confirmation message. Opting out of text messages will not affect your ability to use our services or receive communications through other channels (phone, email).

Message and Data Rates

Message and data rates may apply to any text messages sent to or received from Curb Cart Concrete. Message frequency varies based on your account activity and interactions with us. You may receive up to 5 messages per week related to active orders, and up to 4 marketing messages per month if enrolled in promotional messaging. Please contact your wireless carrier for details about your messaging plan and any applicable charges.

Carrier Liability Disclaimer

Curb Cart Concrete is not responsible for any delays or failures in the delivery of text messages. Wireless carriers are not liable for delayed or undelivered messages. Message delivery is subject to effective transmission from your wireless carrier and network availability. Carriers may impose message or charge limitations on your account that are beyond our control. We are not responsible for any fees or charges that your wireless carrier may impose for text messaging services.

Age Restriction

You must be at least 18 years of age to opt in to our SMS/text messaging program. By providing your mobile phone number and consenting to receive text messages, you confirm that you are at least 18 years old and are the account holder or authorized user of the mobile phone number provided. If we become aware that a person under 18 has opted in to our messaging program, we will promptly remove their number from our messaging list.

12. Modifications

We reserve the right to modify these terms at any time. Changes will be effective immediately upon posting to our website. Continued use of our services after changes constitutes acceptance of the modified terms.

13. Severability

If any provision of these terms is found to be unenforceable, the remaining provisions will continue to be valid and enforceable.

14. Entire Agreement

These terms constitute the entire agreement between you and Curb Cart Concrete regarding our services, superseding all prior agreements and understandings.
